MIJE – Maisons Internationales de La Jeunesse et des Etudiants is an officially recognised non-profit organisation founded in 1958, registered as a Youth & Community Education association under the N°75 JEP 04-193, whose head office is located at 13 boulevard Beaumarchais – 75004 PARIS – France, and registered with the register of travel agents and other tour operators under the N° IM 075 10 0395.
Financial Guarantor: UNAT-FMS 8 rue César Franck – 75015 PARIS. Insurer: RC HISCOX Contract N°HA RCP0323871 (5,000,000 €).

PREAMBULE

These General Terms & Conditions of Sale (“Terms”) apply to Individual Bookings made to MIJE using the Internet, via the MIJE website or on site, to the exclusion of any other Bookings and in particular:

– Group bookings, governed by the General and/or Particular Conditions of Sale for Group Sales;
– Mini-group bookings and room rental intended for legal persons, governed by the General Conditions of Sale for Mini-Groups (GCS Mini-Groups);
– Bookings made through intermediaries (online booking agencies etc.), governed by their own contractual conditions.

The services offered by the MIJE are reserved for members of the association who are up to date with the annual payment of their solidarity membership.

Any Booking made on the website hostel.mije.com implies the consultation and express and unreserved acceptance of these Terms by the person who made the Booking (hereinafter referred to as “the Client”),

The Client declares to have full legal capacity to commit to these Terms. They certify the veracity and accuracy of the information provided during the Booking process.

The Terms are accessible at all times on the website hostel.mije.com. The Terms can be subject to modification. The conditions applicable to the Client are those in force at the time of Booking.

Bookings are personal and non-transferable. The Participant agrees to refrain from assigning their Booking.

ARTICLE 1. DEFINITIONS

“Hostel”: refers to all three of the MIJE youth hostels, located in the Marais district of Paris, namely:
– MIJE Hostel Fauconnier, 11 rue du Fauconnier – 75004 Paris;
– MIJE Hostel Fourcy, 6 rue de Fourcy – 75004 Paris;
– MIJE Hostel Maubuisson, 12 rue des Barres – 75004 Paris.
“Shared Room”: refers to a room comprised of several single beds in which the Client books one or more beds.

“Private Room”: refers to a room comprised of one or several single beds in which the Client books all the said beds.

“Client”: refers to the natural person making a Booking at one of the Youth Hostels of the MIJE association.

“No-Show”: refers to the situation in which the Client fails to appear on the first day of their stay without having cancelled their booking.

« Booking»: refers to the action of booking a room and/or one or more beds, for one or several nights with the MIJE in one of the Hostels. The Client has the choice between two types of Booking :

  • Firm Reservation“: refers to a booking, payable in full at the time of ordering, which cannot be modified or refunded in the event of cancellation by the Client. Stays that are the subject of promotional offers, as well as those booked on site, are “Firm Reservations”.
  • Flexible Reservation“: refers to a booking, payable in full at the time of ordering, and which may be subject to reimbursement in the event of cancellation by the Client, in accordance with the cancellation conditions specified in article 5 of these GTC. After validation of a Flexible Reservation, the Client cannot modify it, except to cancel it under the conditions provided (article 5) and make a new Reservation.

ARTICLE 2. BOOKINGS

Bookings can only be made with MIJE:

– online on the MIJE website;
– onsite in one of the Hostels.

The Client’s Booking is made indifferently to the Hostel used for the trip, which will be freely determined by the MIJE at a later date.

2.1 Online Bookings

All Bookings imply the consultation of these Terms and express and unreserved acceptance. The Booking is deemed to be accepted by the Client once the online booking procedure has been completed.

MIJE confirms the Client’s Booking by sending an automatic email to the email address provided by the Client on the Booking form.

MIJE will inform the Customer, before the date of arrival, of the name and address of the hostel.

2.2 Onsite Booking

When a Reservation is made on site, the rates for the categories of accommodation available are communicated to the Client, who is also informed that the Reservation is firm and non-refundable for the entire stay, whatever the reason given. If the proposed conditions are acceptable to the Client, he/she will transmit the information necessary to proceed with the Reservation and pay the full amount of the stay.

The payment of the stay by the Client in order to validate the Reservation confirms that he/she has been informed of and has accepted without reservation the present General Terms and Conditions of Sale, which can be accessed at any time online at hostel.mije.com

ARTICLE 3. RATES

The applicable rate is the one in force on the day of the Booking by the Client.

When making a Booking, the rates displayed can differ depending on the payment and cancellation conditions applicable to the Booking (Firm or Flexible Booking).

Rates are understood to be:
– for Private Rooms, per night and per room.
– for Shared Rooms, per night and per person.

Rates are in Euros including VAT, taking into account the applicable VAT rate on the day of the Booking. Any changes to the applicable VAT rate will automatically be reflected in the prices indicated at the date of invoice.

Breakfast per night stayed is included in the Booking price.

Not included in the Booking price:
– tourist tax in force at the date of the stay, to be paid per night and per adult;
– cost of solidarity membership to the MIJE association, to be paid per person for the current calendar year.

The Client agrees to pay these fees onsite, on the day of arrival.

ARTICLE 4. PAYMENT

4.1. Firm Booking

The Client pays the price of the booking in full, when ordering on the website or onsite. Payment must be made by credit card (American Express not accepted).

4.2. Flexible Booking

The Client pays the price of the booking in full, when ordering on the website or onsite. Payment must be made by credit card (American Express not accepted).

ARTICLE 5. CANCELLATION OR MODIFICATION OF A BOOKING BY THE CLIENT

In accordance with article L.221-28 of the French Consumer Code, the Client does not have a right of withdrawal on the Booking they make.

The sales conditions of the type of Booking chosen (Firm or Flexible) by the Client specify the cancellation terms of the Booking.

Firm Reservations cannot be modified or refunded. In the event of cancellation by the Customer or no-show, the amount paid for the Firm Reservation is due in full and retained by MIJE, regardless of the Customer’s reason.

Flexible Reservations cannot be modified.

They may be cancelled without charge by the Customer, but only under the conditions set out below:

– In order to be taken into account, any cancellation request must be made exclusively by e-mail to the dedicated box ” accueil@mije.com “, specifying the reservation number shown on the confirmation of the stay. The date on which the e-mail is sent will be taken into account as the date of the cancellation period.

– Cancellation without charge up to 4 days before the date of arrival; the full amount paid online will be refunded to the Client and credited back to the bank card used at the time of booking.

For cancellations made between 3 days and the date of arrival, the amount paid is not refundable, whatever the reason. The entire amount paid by the Customer will be retained by MIJE as a cancellation fee.

– In case of no-show, the amount paid is not refundable, whatever the reason. The full amount paid by the Customer will be retained by MIJE as a cancellation fee.

– Any stay started and interrupted due to the customer’s fault is due in full, whatever the reason given; no refund will be made.

Cost of solidarity membership to the MIJE association is not refundable.

ARTICLE 6. CANCELLATION OR MODIFICATION OF A BOOKING BY MIJE

If a transaction is refused by the Client’s bank or the payment card used is deemed invalid, the Booking will be automatically cancelled by MIJE.

In the absence of available beds in the Hostels, MIJE reserves the right to reimburse the Customer or to arrange, for all or part of the stay, the Client’s accommodation in another hostel of equivalent category, for services of the same nature. Any additional costs of the room and public transport costs between the two hostels are covered by MIJE.

The Client cannot claim any other compensation.

ARTICLE 7. RESIDENCE CONDITIONS IN THE MIJE HOSTELS

7.1. Place of residence

MIJE does not guarantee that the entire stay will take place in the same room, or the same Hostel. If there is a change of room during the stay, luggage must be deposited in the luggage facility before midday (12pm). Access to the new room is possible from 3pm onwards. The Client is not entitled to any compensation or damages due to a change of room or Hostel during their stay.

If several beds have been booked in a Shared Room, MIJE does not guarantee that these beds will be in the same Room, or in the same Hostel. Bed allocation is at the discretion of MIJE.

7.2. Check in / out

The Rooms are available from 3pm onwards on the day of the Client’s arrival and must be vacated at midday (12pm) on the day of departure. Failing this, an extra night will be invoiced and debited using the credit card of which the details were provided by the Client as a guarantee upon Booking.

7.3. Minors

Minors under 17 years of age cannot stay in the Hostels without being accompanied by an adult. They must stay in a private room accompanied by an adult.

A 17-year-old Client can stay in one of the Hostels without being accompanied by an adult, providing that on the day of arrival they present a signed parental authorisation and a photocopy of identification documents from one of the parents.

In the event of non-compliance with these conditions, the Booking will be cancelled on arrival. No refund will be made.

7.4. Accessibility

Rooms accessible to persons with reduced mobility cannot be booked on the MIJE website. To check availability and make a booking, please contact the MIJE booking service by email: accueil@mije.com

7.5 Documents to present

Valid proof of ID with photograph (national identity card or passport) must be presented on arrival by the person who made the Booking, as well as for each accompanying person.

Pursuant to article R. 611-42 of the Code of Entry and Residence of Foreigners and the Right of Asylum, all foreign Clients, including EU nationals, are obliged on arrival to fill in and sign an individual police form supplied by MIJE.

Failing this, the Client will be refused entry to the hostel and not being allowed to stay. No refund will be made.

7.6. Rules and regulations

The Client accepts and agrees to respect the Hostel Rules and Regulations that are displayed onsite.

In the event of non-compliance with the Rules and Regulations, the Client might be required to leave the Hostel, without being able to claim any compensation or refund.

Animals are not accepted in the Hostels except for guide dogs, for Bookings in Private Rooms only.

ARTICLE 8. RESPONSIBILITY

Photographs posted on the MIJE website are indicative and do not engage the MIJE.

The Client will be held responsible for any damage, degradation or vandalism that may occur due to the occupation of the premises, by their own fault or that of the persons in their charge. The Client undertakes to fully cover the costs of replacement and restoration due to the damage caused. The payment will be made onsite before departure.

MIJE reserves the right to invoice the Customer for the cost of cleaning up after leaving the hostel. An e-mail will be sent to the Customer indicating the amount of the rehabilitation and enclosing a receipt as well as the methods of payment.

MIJE can only be held responsible for theft or deterioration of purchases and/or personal items within the limits set by article 1953 of the Civil Code.

Each Party shall not be liable to the other Party for any breach of its obligations resulting from an event of force majeure, as defined by the Civil Code and interpreted by French case law. It is expressly agreed that force majeure suspends the performance of the reciprocal obligations of the Parties and that each Party bears the costs arising therefrom.

ARTICLE 9. DATA PROTECTION

The information collected on the Booking form is recorded in a computerised file by MIJE to record and confirm the Bookings and to organise the stays in the Hostels. The processing of Clients’ personal data is necessary to the execution of these Terms. The data are kept for two years in accordance with Article L218-2 of the Consumer Code and archived longer, up to 6 years in accordance with Article L. 102 B of the tax procedures handbook.

MIJE undertakes to refrain from reselling and transferring this data to third parties.

In accordance with the Data Protection Act and (EU) Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 applicable from 25 May 2018, the Client may exercise, to MIJE, their rights of access, rectification, deletion of data, limitation of processing, opposition and right to portability of data to the following address: MIJE – 13 boulevard Beaumarchais – 75004 Paris.

The Client may also lodge any complaint relating to the processing of their personal data, with the National Commission for Data Protection (3 Place de Fontenoy, 75007 Paris; https://www.cnil.fr/).

The Client is informed of the existence of the list of opposition against cold calling “Bloctel”, accessible at: https://conso.bloctel.fr/

The Client authorises MIJE to use the Client’s email address to send the MIJE newsletter, news, promotional offers and an invitation to fill in an online satisfaction survey after their stay.

ARTICLE 10. CLAIMS

Claims relating to the services provided by MIJE must be brought to its attention within eight days of the date of the Client’s departure and this must be done in writing at the following email address: Service-Client@mije.com

ARTICLE 11. DISPUTE RESOLUTION

After having referred to the MIJE quality department to try to resolve the dispute amicably, and if there is no satisfactory answer or absence of response within 60 days from the date of the referral, the Client can refer to the Mediator of Tourism and Travel at no cost. The referral to the Mediator must be made within one year from the date of the Client’s written complaint to the MIJE.

In the absence of agreement between the Client and MIJE, this dispute will be decided by the competent courts.

ARTICLE 12. APPLICABLE LAW

These Terms are governed by French law.

ARTICLE 13. ENTIRETY

These Terms and the Booking confirmation express the entirety of the obligations of the MIJE and the Client.

No general or specific conditions communicated by the Client can be integrated into these Terms.

ARTICLE 14. LANGUAGE

The authentic language is French.

If the Terms are translated into a foreign language, the French language will prevail over any other translation in the event of dispute, litigation, difficulty of interpretation or execution of the present conditions and more generally concerning the existing relations between MIJE and the Client.
